Rules for Cleaning Oil-Containing Ship Waste

Rules of Port of Taichung, Taiwan International Ports Corporation (TIPC) for Cleaning Oil-Containing Ship Waste

  1. This Rule was enacted according to Article 38 of the Commercial Port Law, Article 29 of the Marine Pollution Control Act, Waste Disposal Act, and other environment related regulations.
  2. Waste material cleaning agencies (hereafter referred to as cleaning operator) used to clean up oil-containing ship waste in the Taichung Port area shall be agencies that have been granted approval by the environmental protection competent authority. The following documents shall be submitted to TIPC Port of Taichung (hereafter referred to as this Subsidiary Company) for approval:
    1. (1) Copy of the waste material cleaning permit (permit to clean all types, including that containing oil) issued by the environmental protection competent authority and the waste material cleaning technician's qualification document. 
    2. (2) Operating plan.
    3. (3) Emergency response plan and the pollution prevention plan. 
    4. (4) A copy of the processing agreement proof from the final processing agency:
      A. Waste material intake processing agreement.
      B. Waste material processing permit issued by the environmental protection competent authority.
    5. (5) A copy of the proof that real-time tracking system (GPS) has been installed on all the cleaning transportation vehicles. 
  3. Before the ship owner or its agent commission cleaning operators registered with this Subsidiary Company to engage in cleaning of oil-containing ship waste, the owner or agent shall fill out a "Taichung Port Oil-Containing Waste Cleaning Work Application Form" and submit it to this Subsidiary Company via mail, fax or other ways. 
  4. During the work period, the cleaning operator shall be responsible for the safety of all the personnel and work, and shall be appropriately insured. 
  5. When cleaning operators are conducting oil-containing ship waste processing work, they shall ensure that the pipeline connectors are secure. Contact shall be maintained with the ship to prevent leaks. 
  6. If the cleaning operator causes a pollution event during the cleaning of oil-containing ship waste, the operator shall immediately take emergency response measures that is sufficient to handle the pollution event. This Subsidiary Company's monitoring center shall be notified 04-26642390/04-26562164. The cleaning operator shall be responsible for the damages caused by the pollution. 
  7. The cleaning operator shall be responsible for all incidents caused by the work and its derived responsibilities during their time working in the port. 
  8. When the cleaning operator reports the cleaning or recycled quantity and other work-related situation to the competent authority according to the Waste Disposal Act, this Subsidiary Company shall also be notified. 
  9. If the cleaning operator uses ships for the cleaning work, the ship's port access shall be handled according to the commercial port’s port authority rules. Application shall be made to this Subsidiary Company to lease piers/sites according to the rules and fees shall be paid according to the set rate. 
  10. Entry to the port by the cleaning operator's personnel and vehicles for work shall be handled according to the "Application and Use of International Commercial Port Pass."
  11. When the cleaning operator engages in the cleaning of oil-containing ship waste in this port, this Subsidiary Company has the right to assign supervising personnel. The operator shall comply with the Marine Pollution Control Act, Waste Disposal Act, and the Commercial Port Law. The operator shall not violate any laws or regulations, obstruct port safety and order, or pollute the port.
